Associate Megan Feinberg obtained summary judgment in a complex, multiparty medical malpractice action involving an alleged failure to timely diagnose and treat an ectopic pregnancy during her presentation to co-defendant’s hospital. RPGRK represented an obstetrician-gynecologist, whom plaintiff alleged departed from the standard of medical care by failing to coordinate with plaintiff and co-defendant hospital for follow-up diagnostic testing post-discharge. Buttressed with strong expert proof on the motion, Megan successfully argued that the medical record demonstrated that serial testing was not indicated at the time plaintiff emergently presented to the hospital, and that our client’s recommendation for follow-up testing post-discharge to monitor the progression of the pregnancy was entirely within the standard of care, which recommendation plaintiff failed to heed. The Court agreed, and granted the motion in its entirety, dismissing all claims against our client with prejudice.
