Partner Steven W. Kraus obtained a defense verdict in Supreme Court, Nassau County, rejecting plaintiffs’ claims of urological negligence associated with the placement of an artificial urinary sphincter (AUS). The plaintiff claimed the necessity of three additional surgical procedures along with sexual dysfunction and ongoing urinary incontinence. The defense successfully argued that the patient received informed consent, that the procedure was indicated and appropriately performed and that the necessity of subsequent procedures was unrelated to the placement of the device by the defendant urologist.
