In a hotly contested action involving our client, a Managed Long Term Care Plan Administrator and a co-defendant Home Health Agency that was contracted to deliver services to our client’s enrollee, Partner Juan C. Gonzalez recently prevailed on summary judgment in Supreme Court, Kings County resulting in the dismissal of all claims against our client that faced a pre-trial demand of nearly $3 million. Following over half a dozen depositions on highly contested facts and key questions of agency, control, negligent hiring, retention and supervision, the Court agreed that our client owed no duty to plaintiff and issued a dismissal order as a matter of law following oral argument.
