Partner John Paterniti (with assistance from associate Evan Schnittman) earned a hard-fought defense verdict in a medical malpractice action involving allegations of Obstetrical malpractice resulting in Erb’s Palsy to the infant-plaintiff. Plaintiff contended that John’s client failed to perform a cesarean section for a baby in the breech position and, as a result, the infant was injured during delivery resulting in a moderate to severe Erb’s to the left arm. On April 16, 2019, a Westchester County jury found the doctor not liable on each of the three departure questions submitted.
