On May 1st, Partner Juan C. Gonzalez, secured an important victory for our client in a complex medical malpractice action, and yet another in a string of recent victories for the Firm. Following a plaintiff’s verdict, and a successful post-trial motion to set aside the verdict, the Appellate Division, Second Department recently affirmed the trial court’s order setting aside the verdict as against our client, a major health care facility in New York City. In a lengthy written decision, the Court explained the bases for the affirmance on important questions relevant to the requisite evidence and testimony needed to make out proximate causation in cases involving specialist medical consults.
